Welcome to M-AD! These Terms of Service govern your use of M-AD's website located at m-ad.in and the services we provide, including our Bulk SMS and WhatsApp marketing platforms.

1. Acceptance of Terms

By accessing our website and using our messaging services, you accept and agree to be bound by these terms. If you do not agree to these terms, you must not access our platform or use our services.

2. Service Provision and Accounts

To use our messaging features, database campaigns, or WhatsApp Business API integrations, you must register for an account and provide accurate registration data. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Acceptable Use and Compliance

You agree to use our Bulk SMS and WhatsApp API platforms in full compliance with local regulations, including TRAI rules in India, spam guidelines, and Meta’s WhatsApp Business Policy. Specifically, you agree that:

• You will not send unsolicited spam messages (promotional SMS/WhatsApp messages to users who have not opted in).
• All messages sent using our platforms must contain clear identification of the sender.
• You will not broadcast misleading, fraudulent, offensive, or illegal content.
• You will maintain active opt-out records and immediately honor requests to stop communications.

M-AD reserves the right to suspend or terminate accounts that violate these compliance rules without refund.

4. Pricing, Payments, and Validity

All recharges, messaging credits, and setup fees are on a **prepaid basis** and are non-refundable. The billing rates for WhatsApp and SIM-based SMS credits are based on the volume structure selected at recharge:

• For packages with validity limits (e.g. 30, 60, or 90 days), any unused credits will expire at the end of the validity period.
• Under 1,00,000 credits, base rates of ₹1 per message plus applicable taxes apply, with a validity of 7 days.
• Taxes are additional on all package values and recharges.

5. Limitation of Liability

In no event shall M-AD, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the service.
• Any delay or failure in message delivery due to carrier routing, network errors, or Meta platform downtime.
• Unauthorized access, use, or alteration of your transmissions or content.

6. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms of Service at any time. We will provide notice of any material changes by updating the "Last updated" date at the top of this page. Your continued use of our services after changes are posted constitutes acceptance of those changes.
